Regulated Product Stewardship in New Zealand: A Strategic Guide for Manufacturers

For many years, New Zealand's approach to packaging waste relied heavily on voluntary goodwill. Businesses were encouraged to join schemes and reduce waste, but there was no legal requirement to do so. This created an uneven playing field where responsible brands paid for recycling initiatives while others -the "free riders"- paid nothing but sold the same products.

That era is effectively over.

Under the Waste Minimisation Act, the New Zealand Government has pulled its most powerful lever: declaring six categories of waste, including plastic packaging, as "Priority Products."

In my work with trans-Tasman businesses, I have noticed that many confuse this with the Australian system. It is vital to understand the difference. While Australia uses a co-regulatory model (APCO), New Zealand has moved to Regulated Product Stewardship (RPS).

This means participation is no longer optional; it is the law.

This guide outlines what Regulated Product Stewardship means for manufacturers and importers and how to prepare for the operational and financial changes it brings.

The Core Concept: No More Free Riders

The declaration of a "Priority Product" triggers a mandatory requirement for a stewardship scheme to be developed and accredited.

The Old Model (Voluntary):

  • Brands could choose to join the Soft Plastics Recycling Scheme or similar initiatives.

  • Reporting data was voluntary.

  • Funding relied on the generosity of members.

The New Model (Regulated):

  • Mandatory Participation: If you manufacture or import a priority product (like plastic packaging) into New Zealand, you must be part of an accredited scheme. There is no opting out.

  • Mandatory Fees: The cost of managing the waste at the end of its life is shifted to the producer. This is typically funded through a levy placed on the product when it enters the market.

The Financial Impact: Eco-Modulated Levies

The most significant strategic implication for business leaders is the introduction of fees. However, these are unlikely to be a flat tax.

Global best practice -and the direction New Zealand is heading- favours "Eco-Modulation."

This means the fee you pay depends on the design of your packaging.

  • Lower Fees: If your packaging is clear PET, uses recycled content and is easily recyclable in local infrastructure, your levy will likely be lower.

  • Higher Fees: If you use difficult-to-recycle materials (like coloured PET, complex laminates or PVC), you will pay a penalty rate.

This creates a direct financial incentive for sustainable design. The cost of poor packaging is no longer just reputational; it is a line item on your profit and loss statement.

The Operational Impact: Data Granularity

To calculate these levies, the schemes require accurate data.

In the past, many businesses estimated their sales volumes into New Zealand. Under a regulated scheme, this will no longer be sufficient. You will need to report:

  • The exact weight of packaging placed on the market.

  • The specific material composition (polymer type).

  • The percentage of recycled content.

If your internal data systems cannot generate this report today, upgrading them must be a priority.

A Strategic Action Plan for Importers and Manufacturers

As these schemes transition from design to full implementation, businesses must prepare.

  1. 1. Audit Your NZ Portfolio: Identify exactly which of your products fall under the "Priority Product" declaration.

  2. 2. Calculate Potential Liability: Look at your material mix. Are you heavy on materials that will attract high fees? Can you switch to lower-levy materials (like unpigmented plastics) before the fees kick in?

  3. 3. Engage with the Schemes: Schemes such as The Packaging Forum are central to this transition. Ensure you are registered and receiving their updates so you are aware of the fee structures as they are finalised.

Regulated Product Stewardship changes the fundamental economics of selling in New Zealand. It internalises the cost of waste management, forcing manufacturers to take financial responsibility for the entire lifecycle of their packaging.

While this adds a layer of compliance, it also levels the playing field. The free riders are gone.
